Pather Medico - Legal provides mental capacity assessments for the purpose of COP3 form completion for the Court of Protection, and medico-legal consulting services to solicitors. Our registered office is Gemma House, Lilestone St, London NW8 8SS.

What information we collect, use, and why

Medico – legal consulting

We process the personal data of individuals who are obtaining legal advice and the personal data of associated individuals including solicitors.

Mental Capacity Service (COP3)

We process the personal data of individuals who are subjected to mental capacity assessments. We also process the personal data of professionals, family members and others with links to the service being provided.

The personal data may include :-

  • Names and contact details

  • Addresses

  • Dates of birth

  • Third party information (such as family members or other relevant parties)

  • Payment details (including bank information for transfers)

  • Usage data (including information about how you interact with and use our website and services)

  • Health information relevant to the mental capacity assessment

  • Audio recordings of the mental capacity interview which will be retained only for the purposes of completing the form / report.

Lawful bases and data protection rights

  • Your right to rectification – you have the right to ask us to correct or delete personal information you think is inaccurate or incomplete.

  • Your right to withdraw consent – when we use consent as our lawful basis you have the right to withdraw consent at any time.

Our lawful bases for the collection and use of your data

Our lawful bases for collecting or using personal information to provide services for clients are:

  • Consent - we have permission from you after we give you all the relevant information. All of your data protection rights may apply, except the right to object. To be clear, you do have the right to withdraw your consent at any time.

  • Contract – we have to collect or use the information so we can enter into or carry out a contract with you. All of your data protection rights may apply except the right to object.

  • Legitimate interests – we’re collecting or using your information because it benefits you without causing an undue risk of harm to anyone. All of your data protection rights may apply, except the right to portability. Our legitimate interests are:

    • We require personal data to carry out the task of completing mental capacity assessments and completing the COP3 form for the Court of Protection. The details of the client to whom the data pertains as well as the details of the person making the application are necessary to carry out this task.

    • We require personal data to provide the necessary consulting service to legal professionals.

We keep your information for 8 years in line with professional requirements.

Who we share information with

Dr. Pather works alone so information is not shared internally. Data is held electronically on an encrypted hard drive. We do not hold paper records. The only people external to Pather Medico – Legal that data can be shared with are :

  • Legal professionals

  • The Court of Protection

  • HMRC if requested

  • With others pursuant to a court order

We use social media platforms such as Facebook and Twitter. Their privacy policies can be found by visiting their respective websites. If you have contacted us using one of these platforms, we may reply using the same method but will not process your information outside of these platforms without your prior consent or unless it is in our legitimate interests to do so.

The website uses a contact form to make contacting Pather Medico – Legal simple. The contact form sends an email to a secure encrypted email client where your data is stored to ensure that we can respond to your message.

How to complain
